Terms and Conditions

1. ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Jeffrey David Golf, LLC ("Company," "we," "us," or "our") governing your use of the Dream Putt application ("App," "Software," or "Service").

By purchasing a subscription, accessing Demo Mode, or using any features of Dream Putt, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the App.

2. DESCRIPTION OF SERVICE

Dream Putt is an immersive putting simulator application designed to provide golf putting practice, training drills, game modes, and performance analytics. The App is intended for entertainment, training, and skill development purposes.

Game Modes and Features:

Dream Putt offers various game modes and features, including but not limited to:

Practice Mode: Free-form putting practice with customizable settings
Drills: Structured training exercises designed to improve specific putting skills
Performance Analytics: Detailed statistics and insights on your putting performance

Features and game modes may be added, modified, or removed at our discretion. Some features may require an active internet connection.

3. SYSTEM REQUIREMENTS AND COMPATIBILITY

Required Hardware (Current Version):

To use Dream Putt, you must have the following equipment:

Headset: Apple Vision Pro (2024 and later)
Launch Monitor: Square Golf Launch Monitor
Internet Connection: Required for account creation, subscription activation, data synchronization, multiplayer, leaderboards, and certain features

Compatibility Disclaimer:

Dream Putt is specifically designed and optimized for the hardware listed above. We do NOT guarantee compatibility with:

Other mixed-reality or virtual reality headsets
Other launch monitors or golf tracking devices
Older versions of Apple Vision Pro hardware
Modified or jailbroken devices
Third-party accessories or peripherals not explicitly supported

Future Compatibility:

We may expand compatibility to additional devices in the future. Any such expansion will be announced through official channels. Compatibility with future hardware is not guaranteed and may require separate license purchases or updates.

Performance Disclaimer:

Even with supported hardware, performance may vary based on:

Device condition and age
Operating system version
Available storage and memory
Network connection quality
Environmental factors (lighting, space, interference)

We are not responsible for performance issues arising from hardware limitations, environmental conditions, or user configuration.

4. AGE REQUIREMENTS

Dream Putt is intended for users aged 13 years and older. By using this App, you represent and warrant that you are at least 13 years of age. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Parental Rights: Parents or legal guardians of users under 18 may request deletion of their child's data at any time by contacting us at the email address provided in Section 23. We will comply with such requests promptly.

5. LICENSE GRANT

Subject to your compliance with these Terms, Jeffrey David Golf, LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Dream Putt for personal, non-commercial purposes.

Subscription: Access to the full version of Dream Putt requires a valid subscription purchased through authorized channels. Each subscription is for individual use only and may not be shared, sold, or transferred.

Demo Mode: The App may offer a Demo Mode with limited features for evaluation purposes. Demo Mode access is provided at our sole discretion and may be modified or discontinued at any time.

6. LICENSE RESTRICTIONS

You agree NOT to:

Copy, modify, distribute, sell, or lease any part of the App
Reverse engineer, decompile, or disassemble the Software
Remove or alter any proprietary notices or labels
Use the App for any illegal or unauthorized purpose
Share your subscription with others or use another person's subscription without authorization
Attempt to gain unauthorized access to any portion of the App or its related systems
Use the App in any manner that could damage, disable, overburden, or impair our servers or networks
Use automated systems (bots, scripts) to access the App or manipulate leaderboards
Cheat, exploit bugs, or use unauthorized third-party software to gain unfair advantages
Harass, abuse, or harm other users in multiplayer modes

7. MULTIPLAYER AND ONLINE FEATURES

Online Conduct:

When using multiplayer, challenges, leaderboards, or other online features, you agree to:

Treat other users with respect and courtesy
Not engage in harassment, bullying, hate speech, or discriminatory behavior
Not use offensive, vulgar, or inappropriate usernames or communications
Not spam, advertise, or solicit other users
Not impersonate others or misrepresent your identity
Play fairly without cheating or exploiting game mechanics

Leaderboards and Rankings:

Leaderboard positions are based on performance data collected during gameplay
We reserve the right to remove scores or rankings that appear fraudulent or achieved through cheating
Leaderboards may be reset periodically or during major updates
We do not guarantee the accuracy or permanence of leaderboard data

Multiplayer Availability:

Multiplayer features require an internet connection and may not always be available
We may perform maintenance, updates, or modifications that temporarily disable online features
We are not responsible for connection issues, lag, or other network-related problems
Multiplayer sessions may be subject to additional rules or codes of conduct

Enforcement:

Violation of online conduct rules may result in:

Removal from leaderboards
Temporary or permanent suspension of online features
Termination of your license and/or subscription (see Section 16)

8. DATA COLLECTION AND USE

Information We Collect:

Dream Putt collects and stores the following types of data to improve usability, provide support, and enhance your experience:

User interactions and navigation patterns
Putt data (distance, accuracy, speed, etc.)
Drill result data and performance metrics
Session data (duration, frequency, timestamps)
Performance analytics and statistics
Display preferences and settings
Device information and technical diagnostics
Multiplayer interactions and communications
Leaderboard and challenge participation data

Purpose of Collection:

We collect this data to:

Improve the App's functionality and user experience
Provide personalized performance analytics
Offer technical support and assistance
Identify and fix bugs or technical issues
Develop new features and enhancements
Maintain leaderboards and competitive features
Prevent cheating and ensure fair play

Data Identification:

The data collected can be traced back to your identity through your subscription or device identifiers. We treat this information as personal data and handle it in accordance with applicable privacy laws.

Data Retention and Deletion:

You may request deletion of your data at any time by contacting us
Parents/guardians may request deletion of data for users under 18
We will comply with deletion requests within 30 days
Some data may be retained for legal or operational purposes as required by law
Deletion of data may result in loss of progress, statistics, and leaderboard positions

Third-Party Sharing:

We do not sell your personal data to third parties. We may share anonymized, aggregated data for analytical and marketing purposes. Any third-party service providers we use are bound by confidentiality agreements.

9. USER RESPONSIBILITIES

You are responsible for:

All activities that occur under your subscription
Ensuring your use complies with all applicable laws
Providing accurate information when contacting support
Using the App in a safe environment appropriate for physical activity
Any equipment or hardware used in connection with the App
Ensuring your hardware meets the minimum requirements
Maintaining adequate internet connectivity for online features
Your conduct in multiplayer and online interactions
Backing up any data you wish to preserve before updates or reinstallation

10. INTELLECTUAL PROPERTY

All content, features, functionality, software code, graphics, user interface, design, and trademarks in Dream Putt are owned by Jeffrey David Golf, LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You acknowledge that the App contains proprietary information and materials that are protected by applicable intellectual property and other laws. You agree not to use such proprietary information or materials in any way except as expressly permitted by these Terms.

User Performance Data:

While you retain ownership of your personal performance data, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and analyze such data for the purposes described in Section 8 and our Privacy Policy.

11. UPDATES AND MODIFICATIONS

We reserve the right to:

Modify, update, or discontinue the App or any features at any time without notice
Change these Terms at any time by posting updated Terms within the App or on our website
Require users to accept updated Terms to continue using the App
Add, remove, or modify game modes, features, or content
Adjust leaderboards, challenges, or competitive elements
Update hardware requirements or compatibility

Your continued use of Dream Putt after any modifications constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.

Updates and Patches:

We may release updates, patches, or new versions of the App
Some updates may be required to continue using the App
Updates may change features, fix bugs, or improve performance
We are not obligated to provide updates or maintain backward compatibility

12. PAYMENT AND REFUNDS

License Subscription: Access to Dream Putt requires an active subscription purchased through authorized channels. Subscription pricing and billing periods are displayed at the time of purchase.

Subscription Options:

- Dream Putt All-Access Individual (1 Year): $249.99 per year
Duration: 12 months, automatically renews every 365 days

- Dream Putt All-Access Individual (Lifetime): $999.99 one-time fee
Duration: Lifetime access, no renewal

Each subscription provides access to all features and functionality of the Dream Putt app.

Subscription Terms:

Subscriptions automatically renew at the end of each billing period unless canceled
You will be charged the then-current subscription rate upon renewal
You may cancel your subscription at any time by turning off auto-renewal in your Apple ID Account Settings
Cancellation takes effect at the end of the current billing period
You will continue to have access until the end of your paid period
No refunds or credits will be provided for partial subscription periods

Billing:

Payment is processed through our authorized payment providers
You authorize us to charge your payment method for all subscription fees
You are responsible for maintaining valid payment information
Failed payments may result in suspension or termination of access

Apple In-App Purchase Terms:

All subscriptions are processed through Apple's In-App Purchase system
Payment will be charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

Family Sharing: Subscriptions do not support Apple Family Sharing.

Restore Purchases: If you reinstall the App or use it on a different device, you can restore your subscription by using the "Restore Purchases" option in the App, which will verify your purchase through your Apple ID.

Refund Policy: All purchases are subject to Apple's refund policy. Refund requests must be submitted directly to Apple through reportaproblem.apple.com or Apple Support. We do not process refunds directly for App Store purchases. Apple determines refund eligibility based on their policies.

Price Changes: We reserve the right to modify subscription pricing at any time. Price changes will be communicated in advance and will take effect at your next renewal date. Your continued subscription after a price change constitutes acceptance of the new pricing.

Free Trials: We may offer free trial periods at our discretion. Trial terms will be clearly disclosed at sign-up. If you do not cancel before the trial ends, you will be automatically charged for a subscription.

13. DISCLAIMER OF WARRANTIES

DREAM PUTT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, secure, or error-free
Defects will be corrected
The App is free of viruses or harmful components
Results obtained from use will be accurate or reliable
The App will be compatible with all hardware configurations
Online features will always be available
Leaderboards or statistics will be accurate or permanent
Multiplayer connections will be stable or lag-free

Physical Activity Warning: Dream Putt may involve physical activity including swinging golf clubs in a mixed-reality environment. You assume all risks associated with such activity. Consult a physician before beginning any exercise program. Use the App in a safe environment with adequate space, proper flooring, and no obstacles. Ensure all persons and pets are at a safe distance. We are not responsible for any injuries or property damage resulting from use of the App.

Hardware Disclaimer: We are not responsible for damage to your Apple Vision Pro, Square Golf Launch Monitor, or any other equipment resulting from use of Dream Putt. Use all hardware according to manufacturer guidelines.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEFFREY DAVID GOLF, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from the App
Any bugs, viruses, or harmful code transmitted through the App
Any errors or omissions in content or for any loss or damage incurred as a result of your use of any content posted or shared through the App
Physical injury or property damage resulting from use of the App
Hardware incompatibility or malfunction
Loss of leaderboard positions, statistics, or progress
Multiplayer connection issues or unavailability
Actions of other users in multiplayer modes
Any third-party hardware or services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU FOR THE SUBSCRIPTION, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Jeffrey David Golf, LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations
Your conduct in multiplayer or online features
Physical injury or property damage resulting from your use
Your use of incompatible or unsupported hardware

16. TERMINATION

We reserve the right to suspend or terminate your access to Dream Putt at any time, with or without cause, with or without notice, effective immediately. This includes termination for:

Violation of these Terms
Fraudulent or illegal activity
Abuse of the Service or other users
Non-payment or chargebacks
Cheating or exploiting game mechanics
Harassment or misconduct in multiplayer modes
Manipulation of leaderboards or statistics

Upon termination:

Your license to use the App immediately ceases
You must cease all use of the App
We may delete your data in accordance with our retention policies
You will lose access to all online features, leaderboards, and progress
Sections of these Terms that by their nature should survive termination shall survive
No refund will be provided for terminated licenses

17. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Jurisdiction: Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Brevard County, Florida, and you hereby consent to personal jurisdiction and venue therein.

Informal Resolution: Before filing a claim, you agree to contact us at the email address below to attempt to resolve the dispute informally.

Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in Brevard County, Florida. You waive any right to a jury trial or to participate in a class action.

18. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy (https://slopegraide.com/pages/dream-putt-privacy-policy), constitute the entire agreement between you and Jeffrey David Golf, LLC regarding the use of Dream Putt and supersede all prior agreements and understandings, whether written or oral.

20. NO WAIVER

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Jeffrey David Golf, LLC.

21. ASSIGNMENT

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you.

22. EXPORT COMPLIANCE

You agree to comply with all applicable export and import control laws and regulations in your use of Dream Putt. You represent that you are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country.

24. ACKNOWLEDGMENT

BY USING DREAM PUTT, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT YOU HAVE REVIEWED OUR PRIVACY POLICY AND UNDERSTAND HOW YOUR DATA IS COLLECTED AND USED.
